1.Agreement to Terms

By accessing or using the website jmfootballacademy.com (the "Site") and any associated services, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our website or engage our services. These terms constitute a legally binding agreement between you and NeroNoLimit (Pty) Ltd, a company registered in the Republic of South Africa under Company Registration Number K2024148395 ("Company," "we," "us," or "our").

2.Description of Services

NeroNoLimit provides football placement services for aspiring footballers seeking opportunities with professional and semi-professional clubs in Europe. Our services include but are not limited to:

• Player assessment and screening
• Placement preparation and documentation support
• Trial coordination with partner football clubs
• Half-season and full-season placement programs
• Ongoing player support, progression planning, and reporting

Our services are professional in nature. We do not guarantee any specific outcome, including but not limited to signing with any specific club, progression to professional level, or financial outcomes. See our Results Disclaimer below for more detail.

3.Eligibility

Our services are intended for individuals capable of entering into a binding agreement. Where the player is under the age of 18, all services require the involvement, consent, and active participation of a parent or legal guardian. By engaging our services on behalf of a minor, you represent and warrant that you are the parent or legal guardian of the player and have full authority to enter into this agreement on their behalf.

4.Inquiries, Applications, and Engagements

Submitting an inquiry or application through the Site does not create a binding agreement between you and NeroNoLimit. It initiates a screening and consultation process. Any placement engagement is subject to:

• Successful assessment of the player by our team
• Acceptance of the player by NeroNoLimit
• Signing of a formal placement agreement
• Payment of agreed fees and any associated costs

5.Payment Terms

Fees for our placement services are communicated during the consultation process and are governed by a separate formal placement agreement signed between NeroNoLimit and the client. All payments are processed through authorised third-party payment processors. Once signed, you agree to fulfil all financial commitments under your selected placement plan, regardless of your level of ongoing participation, except as provided in the refund and cancellation terms within the placement agreement.

By engaging our services, you authorise NeroNoLimit to charge your payment method for all agreed amounts. You agree to attempt to resolve any payment dispute directly with us before initiating a chargeback with your bank or card provider.

6.Results Disclaimer

We do not guarantee placement, signing, club acceptance, league progression, or any specific football or financial outcome. Any examples, testimonials, case studies, or success stories shared on the Site or in our communications reflect individual experiences and are not typical. Results depend on numerous factors outside our control, including but not limited to player ability, work ethic, age, injury, club requirements, market conditions, and circumstances we cannot reasonably influence. Your results may vary.

7.Intellectual Property

All content on the Site and in our programs — including text, video, images, logos, training materials, frameworks, and templates — is the proprietary intellectual property of NeroNoLimit (Pty) Ltd or used under licence. You are granted a limited, non-transferable, non-exclusive licence to access this content for your personal use in connection with our services. You may not reproduce, distribute, resell, share, or publicly display any of our content without prior written consent.

8.User Responsibilities

As a client or user of our Site, you agree to:

• Provide accurate and complete information during inquiry, application, and onboarding
• Use our materials and services solely for the purpose intended
• Not share login credentials, materials, or proprietary content with third parties
• Conduct yourself professionally in all interactions with our staff, partner clubs, and other clients
• Comply with all applicable laws and regulations in your jurisdiction and in any country where you travel for our services
• Take full responsibility for your own decisions and outcomes

9.SMS Program & Text Messaging

By opting in to receive SMS messages from NeroNoLimit (Pty) Ltd, you agree to the following:

• Message types: Messages related to your inquiry, application status, scheduled consultations and reminders, placement updates, document requests, and (with separate consent) marketing offers and program announcements.
• Frequency: Message frequency varies. During the application, consultation, and onboarding phases, you may receive multiple messages per week. After engagement begins, frequency depends on your placement stage. Marketing messages, if you have consented to them separately, are sent periodically.
• Opt-out: You can cancel the SMS service at any time. Text STOP to the number you received messages from. We will send an SMS to confirm you have been unsubscribed, after which you will no longer receive SMS messages from us. To rejoin, sign up as you did the first time.
• Costs: Message and data rates may apply for any messages sent to or from us. If you have questions about your text or data plan, contact your wireless provider.
• Support: If you are experiencing issues with the messaging program, reply HELP for assistance or contact [email protected].
• No condition of purchase: Consent to receive SMS messages is not required as a condition of purchasing or engaging any service from NeroNoLimit.
• Carrier liability: Carriers are not liable for delayed or undelivered messages.

10.Age Restrictions and Minors

Our services are directed at footballers, who may be under the age of 18. Any engagement involving a minor requires the explicit consent and active involvement of a parent or legal guardian throughout the process. The parent or legal guardian is the contractual counterparty in any placement agreement involving a minor.

We do not knowingly collect personal data from a minor without the consent and involvement of a parent or legal guardian. If we learn that we have collected such data without proper consent, we will terminate the relevant interaction and delete the data promptly.

11.Limitation of Liability

To the maximum extent permitted by law, NeroNoLimit (Pty) Ltd, its directors, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our Site or services, including but not limited to loss of profits, loss of opportunity, injury, travel disruptions, or visa or immigration outcomes outside our control. Our total liability for any direct damages shall not exceed the amount you have paid to us for services in the twelve (12) months preceding the claim.

You acknowledge that football placement outcomes depend on individual performance, club decisions, regulatory factors, and numerous factors outside our control.

12.Indemnification

You agree to indemnify, defend, and hold harmless NeroNoLimit (Pty) Ltd, its affiliates, and their respective directors, employees, and contractors from any claims, damages, losses, costs, or expenses (including reasonable legal fees) arising out of your use of the Site or our services, your violation of these Terms, or your infringement of any third-party rights.

13.Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, including for breach of these Terms, breach of the placement agreement, abusive or disruptive behaviour, fraudulent activity, or sharing of proprietary content. In the event of termination for cause, no refund will be issued except as required by law or as provided in the placement agreement.

14.Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, pandemics, governmental restrictions, transportation disruptions, club closures, league or federation changes, visa or immigration restrictions, or political instability in any country relevant to our services.

15.Governing Law and Dispute Resolution

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of our services shall be resolved in the competent courts of South Africa.

16.Changes to These Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our Site or services after changes constitutes acceptance of the revised Terms.
